What are the Roles in the Mediation Process

Mediator
The mediator controls the process of the mediation and serves as a guide throughout the process. the mediator assists with the communication and decision making process by collecting data and pertinent information from each party. The mediator will normally offer suggestions/alternatives while exploring consequences and working towards a resolution and agreement between the parties. The mediator will share all information collected during the process, with each party, unless asked specifically to keep confidential. Confidential information will never be shared.

Parties
The mediation process is very different from what it would be in a courtroom. The parties are in control of the decision making and outcome, which is the focus and benefit of mediation. Both parties should come to the mediation with an open mind and ready to settle issues and disputes in a non-confrontational environment. Neither party will walk away with 100% of their requests, but through the give and take process, an agreement can be reached where both parties feel that the final results are fair and that the final agreement is something both parties can live with.

Attorneys
Unlike a courtroom, your attorney will work in an advisory role only. YOU will make all decisions. Your attorney should be present to offer legal advice and to act as your advocate during the mediation process.
